Hi SoCal Members!

This month's HTCIA Meeting will be a presentation by the Los Angeles District Attorney's Office. This meeting will give members an insight into biometrics investigations. The presenter will be Benyomin Forer from the DA's office.

Topic Info: Mobile phones and computers may be locked or encrypted by means of a password or some form of biometrics, such as a finger print. Government agencies have sought with mixed results court orders compelling suspects to provide passwords or biometrics to locked phones or decrypt computers or drives. In examining its application to the Fifth Amendment privilege against self-incrimination, the Supreme Court has established that, in ordered to be testimony, [a defendant’s] communication must itself, explicitly or implicitly, relate a factual assertion or disclose information. Only then is a person compelled to be a ‘witness’ against himself. Put another way, an individual must show three things to fall within the ambit of the Fifth Amendment: (1) compulsion, (2) a testimonial communication or act, and (3) incrimination. The issue arises, what are methods for officers to gain access to a suspects device and can a suspect be compelled to unlock the device...
